Webinar: The intricacies of Executor Removal
In this talk, we will delve into the intricacies of executor removal, which can be a critical aspect of estate management. The discussion will encompass both voluntary renunciation and forced removal, before and after the Grant of Probate, with or without the consent of the outgoing executor.
We will explore the nuances of renunciation and how intermeddling can impact the proposed renunciation. The session will cover the procedural steps for applications for directions in the Probate Registry on who should take the Grant. Furthermore, we will examine applications under section 50 of the Administration of Justice Act 1985, including the circumstances under which such applications are necessary and the implications thereof.
The talk will also address when an independent administrator is required, particularly in situations where conflicts between beneficiaries may arise. We will discuss the pivotal role they play in litigation and will touch upon derivative actions and the assignment of causes of actions to the beneficiaries.
